Maple Noir reserves the right to modify these Terms at any time. Any updates become effective immediately upon publication on the website. Customers are encouraged to review these Terms periodically before making a purchase.

Article 4 – Products and Offers

All product descriptions, photographs, specifications, sizing information, colors, and other content published on our website are provided as accurately as reasonably possible.

If payment has already been processed for a cancelled order, the Customer will receive a full refund using the original payment method.

Nothing contained on this website constitutes a legally binding offer until an order has been accepted and confirmed by Maple Noir.

Article 5 – Formation of the Agreement

A purchase agreement between Maple Noir and the Customer is concluded once the Customer places an order through the website and Maple Noir sends an order confirmation by email.

Submitting an order does not automatically constitute acceptance of that order. Maple Noir reserves the right to refuse, cancel, or limit any order prior to shipment for reasons including, but not limited to:

product unavailability;
suspected fraud or unauthorized activity;
incorrect pricing or product information;
payment authorization failure;
violations of these Terms of Service.

If an order is cancelled after payment has been received, Maple Noir will refund the amount paid using the original payment method.

Customers are responsible for ensuring that all information provided during checkout, including billing details, shipping address, and contact information, is accurate and complete.

Maple Noir is not responsible for delays, failed deliveries, or additional costs resulting from inaccurate or incomplete information provided by the Customer.

Reasonable technical and organizational measures are implemented to help protect electronic communications, payment transactions, and customer information processed through the website.

Article 6 – Returns

Customers may request a return within 30 days after receiving their order, subject to the conditions set out in Maple Noir's Refund & Return Policy.

Before returning any product, Customers must contact Maple Noir by email at contact@maplenoir.com to obtain return authorization and return instructions.

Returns sent without prior authorization may be refused.

To qualify for a return, products must:

be unworn and unused;
remain in their original condition;
have all original tags attached;
be free from stains, odors, damage, or alterations;
be returned, where possible, in their original packaging.

Customers are responsible for providing proof of shipment when returning products.

Failure to comply with these return requirements may result in the return being refused.

Article 7 – Return Shipping Costs and Refunds

Unless otherwise required by applicable law, Customers are responsible for all return shipping costs.

Original shipping charges are non-refundable except where:

the Customer received an incorrect product;
the product arrived damaged or defective;
Maple Noir has otherwise agreed in writing.

Once an approved return has been received and inspected, Maple Noir will process the applicable refund using the original payment method.

Approved refunds are generally issued within 14 business days after the returned item has been received and inspected. Depending on the payment provider or financial institution, additional processing time may apply.

If a returned product does not satisfy the return conditions outlined in these Terms or the Refund & Return Policy, Maple Noir reserves the right to reject the refund request and return the product to the Customer.

Article 8 – Non-Returnable Products and Exceptions

Certain products cannot be returned or refunded where permitted by applicable law.

These may include, but are not limited to:

personalized or custom-made products;
gift cards;
final sale or clearance items;
products that cannot be returned for hygiene or health protection reasons once opened or worn;
any item specifically identified as non-returnable at the time of purchase.

Where a product is not eligible for return, this will be clearly indicated on the relevant product page or during checkout.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded under applicable law.

Where required by law, statutory consumer guarantees remain fully applicable regardless of any limitation contained in these Terms.

Maple Noir reserves the right to change product prices at any time without prior notice. However, price changes will not affect orders that have already been accepted and confirmed.

Although we make every effort to ensure that all pricing and product information is accurate, occasional typographical errors, technical inaccuracies, or omissions may occur. Maple Noir reserves the right to correct any such errors and to cancel or refuse orders placed using incorrect pricing or product information.

If an order is cancelled due to a pricing error after payment has been received, the Customer will receive a full refund using the original payment method.

Promotional offers, discount codes, and limited-time sales are subject to their own specific terms and may not be combined unless expressly stated.

Article 10 – Product Compliance and Warranty

Maple Noir strives to ensure that all products supplied conform to the description provided on the website and meet reasonable standards of quality and workmanship.

Customers should inspect their order promptly upon delivery.

If a product is received damaged, defective, or incorrect, the Customer must notify Maple Noir as soon as reasonably possible by contacting contact@maplenoir.com and providing:

the order number;
a description of the issue; and
clear photographs showing the defect or incorrect item.

Where a claim is approved, Maple Noir may, at its sole discretion:

replace the product;
provide a refund; or
offer another appropriate solution.

Normal wear and tear, accidental damage, misuse, improper care, unauthorized repairs, alterations, or failure to follow care instructions are not considered manufacturing defects and are not covered by this policy.

Nothing contained in these Terms limits any statutory consumer rights that cannot legally be excluded under applicable law.

Article 11 – Delivery

Maple Noir makes every reasonable effort to process and dispatch orders promptly.

Estimated delivery times displayed on the website are estimates only and are not guaranteed unless expressly stated otherwise.

Delivery times may vary due to factors beyond our reasonable control, including but not limited to:

customs inspections;
transportation delays;
severe weather;
public holidays;
carrier disruptions;
high seasonal demand.

Maple Noir shall not be liable for delays caused by circumstances outside its reasonable control.

Orders will be delivered to the shipping address provided by the Customer during checkout.

The Customer is responsible for ensuring that the shipping information is complete and accurate. Maple Noir cannot be held responsible for failed deliveries resulting from incorrect or incomplete address information supplied by the Customer.

If an order cannot be fulfilled due to product unavailability, Maple Noir may, at its discretion:

offer a suitable replacement product;
provide the Customer with alternative options; or
issue a full refund.

Risk of loss and ownership of the products transfer to the Customer upon successful delivery to the shipping address provided in the order, unless otherwise required by applicable law.

Orders shipped to Canada are generally delivered without additional customs or import charges. However, if Canadian customs authorities impose unexpected duties, taxes, or import fees, such charges remain the responsibility of the Customer.

Article 12 – Payment

Payment must be completed at the time an order is placed using one of the payment methods made available during checkout.

All payments are processed through secure third-party payment providers. Maple Noir does not store or have direct access to customers' complete payment card information.

If a payment is declined, reversed, or cannot be successfully processed, Maple Noir reserves the right to suspend, cancel, or refuse the order until payment has been successfully received.

The Customer is responsible for providing accurate payment information and must promptly notify Maple Noir of any errors or unauthorized use relating to their order.

Maple Noir reserves the right to take reasonable measures to prevent fraudulent transactions and may request additional verification before accepting or processing an order.

Article 13 – Complaints

Customer satisfaction is important to Maple Noir.

If you have a complaint regarding a product, your order, or our services, please contact us as soon as possible at:

To help us resolve your complaint efficiently, please include:

your order number;
a detailed description of the issue; and
photographs where applicable.

Maple Noir aims to acknowledge all complaints within 5 business days and will make every reasonable effort to provide a substantive response within 14 business days.

If additional time is required to investigate a complaint, we will notify the Customer and provide an estimated timeframe for resolution.

Submitting a complaint does not suspend the Customer's payment obligations unless otherwise required by applicable law.

Where a complaint is found to be justified, Maple Noir may, at its sole discretion:

replace the product;
provide a refund;
issue store credit; or
offer another appropriate solution.

Article 14 – Governing Law

These Terms of Service, together with any separate agreements through which Maple Noir provides products or services, shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles.

Nothing in these Terms limits any mandatory consumer protection rights available under applicable law.

Any dispute arising out of or relating to these Terms or the use of the Maple Noir website shall, where permitted by applicable law, be submitted to the competent courts of Belgium.

Entire Agreement

These Terms of Service, together with our Privacy Policy, Refund & Return Policy, and any other policies published on the Maple Noir website, constitute the entire agreement between Maple Noir and the Customer regarding the use of our website and the purchase of our products.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The failure of Maple Noir to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
