General terms and conditions

These Terms and Conditions are drafted to be transparent, legally compliant, and customer-friendly for both European and international customers, with special attention to customers in Canada.
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Withdrawal period: the period within which the consumer can exercise their right of withdrawal.
- Consumer: any natural person acting for purposes outside their trade, business, craft, or profession.
- Day: calendar day.
- Entrepreneur: Maple Noir, the natural or legal person offering products at a distance to consumers.
- Distance contract: a contract concluded through an organized system for distance selling, without the simultaneous physical presence of the consumer and the entrepreneur.
- Durable medium: any means that allows the consumer to store information in a way that enables future consultation.

Article 3 – Applicability
- These terms and conditions apply to every offer from Maple Noir and every distance contract concluded.
- By placing an order, the consumer acknowledges having read and agreed to these terms and conditions.
- If mandatory consumer protection laws in the consumer’s country of residence provide a higher level of protection than these terms, those legal provisions shall prevail.
Article 4 – The Offer
- All offers are without obligation and may be changed by Maple Noir.
- Product descriptions and images are presented as accurately as possible. Minor color or detail differences may occur and do not entitle the consumer to compensation.
- Prices are exclusive of any import duties, customs fees, and local taxes that may apply outside the EU. These costs, if applicable, are the responsibility of the consumer.
Article 5 – Formation of the Agreement
- The agreement is concluded once the consumer accepts the offer and the order is successfully completed.
- After ordering, the consumer will receive an electronic order confirmation.
- Maple Noir reserves the right to refuse an order for valid reasons, such as payment issues or product unavailability.
Article 6 – Right of Withdrawal (Return Policy)
- The consumer has the right to withdraw from the contract within 14 days of receiving the product without providing any reason.
- During the withdrawal period, the consumer must handle the product with care. The product may only be tried or inspected as it would be in a physical store.
- The product must be returned unused, unwashed, undamaged, and with all original labels intact.
- To request a return, the consumer must contact contact@maplenoir.com within 14 days.
Article 7 – Return Costs and Refunds
- If the return is due to an error by Maple Noir (damaged, incorrect, or defective product), return costs will be covered by Maple Noir.
- In all other cases, return costs are the responsibility of the consumer.
- Refunds will be processed via the original payment method within 7 days of approval of the return. PayPal refunds may be processed faster.
- Shipping costs are non-refundable if the return is not due to an error by Maple Noir.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
- Custom-made or personalized products;
- Hygienic products if the seal has been broken;
- Products that are clearly of a personal nature.
Article 9 – Prices
- All prices are stated in the currency displayed on the website.
- Maple Noir reserves the right to change prices without prior notice.
- Obvious errors or mistakes do not bind Maple Noir.
Article 10 – Conformity and Warranty
- Maple Noir guarantees that the products meet the agreement and reasonable expectations of the consumer.
- Any defects must be reported in writing within 30 days of receipt.
- Statutory consumer rights remain fully applicable at all times.
Article 11 – Delivery
- Orders will be shipped as soon as possible, no later than 30 days.
- If delivery is delayed, the consumer will be informed.
- The risk of damage or loss passes to the consumer upon successful delivery.
Article 12 – Payment
- Payment must be made using the payment methods offered on the website.
- Maple Noir takes appropriate measures to process payments securely.
Article 13 – Complaints Procedure
- Complaints must be reported within 30 days of discovering the issue via contact@maplenoir.com.
- Maple Noir strives to handle complaints within 14 days.
Article 14 – Applicable Law and Disputes
- Belgium law applies to this agreement.
- This does not affect the fact that consumers are also protected under mandatory consumer law in the country where they reside.
Article 15 – CESOP
In accordance with European regulations, payment data may be recorded in the Central Electronic System of Payment Information (CESOP).
